Article 1: Applicability
These General Terms and Conditions of Sale are agreed between, on the one hand, the company Callvin®, whose head office is located at 23 rue Pierre et Marie Curie, Ivry sur Seine, France, listed on the Commerce and Companies Register under the number 482 000 726 000 34, and, on the other hand any natural or legal person wishing to order one or more products from the Callvin® catalogue.
These General Terms and Conditions of Sale are applicable to all orders placed via the website www.callvin.com and all orders received by post or telephone.Without the express written consent of Callvin® no specific condition may override these General Terms and Conditions of Sale. In confirming your order you acknowledge that you have read and accepted the terms of these General Terms and Conditions of Sale.If a condition is found to be lacking, this shall be held to be governed by the distance selling regulations in force in the area where the company's head office is located.
Article 2: Prices
The prices of all our products are given in euros and are inclusive of all taxes.
The prices are net and do not include shipping or delivery costs.
For orders to be sent to countries outside of the European Union, as well as to French overseas territories and départements, products are sold excluding taxes and any excise duty or other local taxes are the responsibility of the recipient.
All orders, regardless of their place of origin, are payable in euros. Callvin® reserves the right to adjust its prices at any time. However, products shall be billed according to the prices shown on the site at the time an order is placed, subject to product availability.
Article 3: Ordering
Callvin® undertakes to accept your order under the terms of these General Terms and Conditions of Sale. Callvin® will honour any order by way or one or several deliveries of the products ordered, subject to product availability.

Callvin® reserves the right to cancel any order that it considers irregular or suspicious, as well as any order placed by a customer with whom there is a dispute, particularly in regard to payment of a previous order.
Article 4: Product Availability
Our products and our prices are valid provided that the products are visible on the website and within the limits of available stock.
Should there be any delay in delivery or product stock shortages following confirmation of your order, we will inform you of this by e-mail or by post as soon as possible.
You will then have the option of exchanging or being refunded for any products that are out of stock or delayed by contacting our customer services department by e-mail at: client@callvin.com or by writing to us at: Callvin, 23 rue Pierre et Marie Curie, 94200 Ivry-Sur-Seine, France.
Article 5: Delivery
Products are delivered to the delivery address that you gave at the time of confirming your order and using the delivery method that you selected ( Colissimo Direct tracked delivery, Colissimo Europe, Colissimo DOM, Chronopost, Fedex...).
The average delivery time for France is 2 to 3 days via Colissimo tracked delivery. For other countries see the ‘Delivery times and shipping costs’ help section.
Should there be any delay in delivery or product stock shortages, an e-mail will be sent to you immediately and you will have the option of exchanging or being refunded for the product or products in question.
You can check the dispatch status of your orders by going to the ‘order tracking’ section of your account or by sending an e-mail to client@callvin.com.
Article 6: Shipping costs
The shipping costs include the costs of preparing and packaging your order as well as the postage costs.
The shipping costs are set at a flat rate which varies according to the delivery method chosen and the destination country for the order.

Article 7: Payment
Payment for your orders can be made by credit or debit card (Carte bleue, Visa, MasterCard). When you confirm your order on our site, you will be put in contact with our bank, HSBC, and you can, in complete security (SSL encryption), enter your card number and expiry date.
Article 8: Right of withdrawal
If the client is the end consumer, he/she has the right to withdraw his/her order within 14 days. This withdrawal must be validated in writing or in text form giving the reasons for returning the goods to Callvin®.
This right of withdrawal does not include products that Callvin® has produced according to the customer’s specifications or according to customisations carried out by Callvin®. This applies particularly to products printed with the customer’s designs (text or image) which, for reasons concerning ownership, cannot be returned or may easily be used, or if the expiry date has passed
Article 9: Retention of title
In accordance with the law of 12 May 1980, any product delivered to the customer is sold subject to retention of title. The transfer of title is subject to payment in full of the product price by the customer within the timeframe agreed between the parties. In case of non-payment of the full product price within the timescale agreed, Callvin® may assert ownership of the products at the expense and risk of the customer.
Article 10: Intellectual Property Rights concerning the printing of designs and responsibilities
When a customer creates a product, using an uploaded image or other medium (customised text), the customer guarantees Callvin® that the product created does not infringe upon the rights of any third party.
Any abuse of rights of authorship and/or brand or domain infringement is the responsibility of the customer. The customer also undertakes not to infringe the rights of any third party in customising a product.
In case of any claim for infringement of the rights of any third party, the customer exonerates Callvin® of all responsibility. The customer bears full responsibility for reimbursing Callvin® for any damages incurred as the result of any legal proceedings.
Article 11: Intellectual property
All elements of the Callvin® website (text, photos, images and sounds) are the exclusive property of Callvin®.
Any person wishing to make private use of any of the elements of the Callvin® website in order to provide links from his/her own website to the Callvin® website must request written permission from Callvin®.
Visiting or ordering from the Callvin® website does not bestow upon the internet user any intellectual or industrial property rights over the editorial or graphical content of the Callvin® website.
Article 12: Personal data
To enable us to process your orders or in order to access the various services of the Callvin® website, you will need to provide us with a certain amount of personal information. Compulsory information consists of your surname, first name, address, e-mail address, and telephone number.
Callvin® undertakes to protect your personal data and maintain the confidentiality of the same. However, such information may be transmitted to third parties for the purposes of direct marketing operations.
If you do not wish to receive such offers, you should log into your account and untick the box ‘I would like to receive exclusive offers from selected key partners of Callvin®’ or send us an e-mail at client@callvin.com or a letter addressed to Callvin, 23 rue Pierre et Marie Curie, 94200 Ivry sur Seine, France, giving your surname, first name, and address.
Processing of your personal data is carried out in accordance with the data processing and civil liberties law of 6 January 1978, giving you the right to access, to rectify and to object to any personal data concerning you. By accepting our General Terms and Conditions of Sale, you acknowledge that you have read and accepted our data protection policy and you consent to us collecting such data and using it.
Article 13: Responsibility
Information concerning products sold by Callvin® is provided based on information provided to us by our suppliers. Callvin® cannot be held responsible in the case of any erroneous information that may have been mistakenly provided.
Photographs of products are shown for illustrative purposes only and are in no way contractual. If you have any misgivings about a product, you can contact us by e-mail at client@callvin.com.Callvin® has a duty of care concerning the services offered to its customers. However, the company cannot be held accountable in the case of neglect of any of its obligations should this be due to events beyond its control (strikes, disasters, software or hardware failures, internet connection problems, etc.).
Article 14: Applicable law
The language of this contract is the English language.
All clauses of these General Terms and Conditions of Sale, all transactions and purchases carried out on the Callvin® website as well as by post and by telephone are governed by French law.
Any dispute which it has not been possible to resolve amicably shall be resolved by the Courts of the town or département where the Callvin® head office is located.
Article 15: Purchaser's acceptance
These General Terms and Conditions of Sale, together with the prices of products sold on the website, are expressly accepted by the purchaser, who asserts and acknowledges having read the same, and, consequently, the purchaser renounces overriding these present conditions by way of any conflicting document, in particular, his/her own General Terms and Conditions of Purchase.
The act of purchase implies the acceptance of these General Terms and Conditions of Sale.
